Terms of service

These Terms of Service (“Terms”) govern your access to and use of the SA Shooter website, online store, and services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Return & Refund Policy (together, the “Policies”). If you do not agree, please do not use the Services.

1. Who we are

2. Eligibility & lawful use

  • You must be 18 years or older and have capacity to contract.

  • You may use the Services only for lawful purposes and in compliance with South African law, including the Consumer Protection Act, 2008 (CPA), Electronic Communications and Transactions Act, 2002 (ECT Act), Protection of Personal Information Act, 2013 (POPIA), and the Firearms Control Act, 2000 (FCA).

  • Products subject to licensing or restrictions (e.g., firearms, ammunition, powders, primers, components, optics fitted to firearms) may require valid permits/licences and KYC verification before sale or handover. We may refuse, cancel, or delay any order until legal requirements are met.

3. Your account

  • You are responsible for your account credentials and for all activity under your account.

  • Notify us immediately of any unauthorised use.

  • We may suspend or terminate accounts that breach these Terms or applicable law.

4. Orders, pricing & availability

  • Placing items in your cart or receiving an order confirmation does not guarantee acceptance. We accept an order when we dispatch it and send you tracking, or when we otherwise confirm acceptance in writing.

  • We may cancel any order (and refund you) for reasons including: stock unavailability, pricing/description errors, suspected fraud, non-compliance with law, or failure to complete KYC/licensing requirements.

  • Prices are in South African Rand (ZAR) and include VAT where applicable. We reserve the right to change prices, product descriptions, and availability at any time.

5. Payment & security

  • We use trusted, PCI-compliant payment gateways. Cardholder data is processed via encrypted channels.

  • By paying, you warrant that you are authorised to use the payment method and that details are accurate.

  • If payment is reversed/charged back, we may suspend fulfilment and/or require alternative payment.

6. Shipping, risk & title

  • Shipping terms (free thresholds, timelines, tracking, courier selection) are set out in our Shipping Policy.

  • Risk of loss passes to you upon delivery to the address you provided (signature on delivery may be required). Title passes upon full payment and lawful transfer/hand-over in accordance with the FCA (where applicable).

  • You must provide accurate delivery information and accept delivery within the courier’s window.

7. Inspection on delivery

  • Inspect parcels on delivery and report damage or discrepancies immediately per our Shipping Policy (ideally in the presence of the courier, with photos).

8. Returns & refunds

  • Our Return & Refund Policy explains DOA/defective procedures, manufacturer assessments, timeframes, non-returnable items (including ammunition, powders, primers), restocking fees for authorised non-defective returns, and refund methods.

  • Nothing in our Policies limits your CPA rights.

9. Manufacturer warranties

  • Many products carry manufacturer warranties. We facilitate assessments/repairs/replacements in line with those warranties and our Policies. Damage from misuse, unauthorised modification, normal wear and tear, or improper handling is excluded.

10. Prohibited conduct

You may not:

  • Use the Services to breach any law or third-party rights;

  • Interfere with website security, integrity, or availability (e.g., scraping, hacking, malicious code);

  • Misrepresent your identity, licences, or purpose of purchase;

  • Upload unlawful, defamatory, infringing, or harmful content.

11. User content (reviews, images, comments)

  • By submitting content (e.g., reviews), you grant SA Shooter a non-exclusive, royalty-free, worldwide licence to use, host, reproduce, modify for formatting, and display such content in connection with the Services and marketing.

  • You warrant that your content is lawful, accurate, and does not infringe third-party rights. We may moderate or remove content at our discretion.

12. Intellectual property

  • All site content (logos, trademarks, product imagery, copy, layouts) is owned by or licensed to SA Shooter and protected by IP laws.

  • You may not copy, reproduce, distribute, or create derivative works without written permission, except as permitted by law for personal, non-commercial use.

13. Third-party services & links

  • We may link to third-party sites or use third-party tools (couriers, payment gateways, finance providers). We are not responsible for third-party content, security, or practices. Use them at your own risk and review their terms and privacy notices.

14. Privacy & data protection

  • We process personal information in accordance with POPIA and our Privacy Policy, including for order fulfilment, legal compliance (FCA/CPA), fraud prevention, and customer support.

  • By using the Services, you consent to such processing and to receiving service communications (e.g., order updates). You can manage marketing preferences per our Privacy Policy.

15. Disclaimers

  • We strive for accurate product descriptions and images but minor variations (e.g., packaging, batch, colour tone) may occur.

  • Except as expressly provided by law or written warranty, the Services are provided on an “as is” and “as available” basis.

  • To the extent permitted by law, we disclaim all implied warranties (merchantability, fitness for purpose) not guaranteed by the CPA.

16. Liability

  • Nothing in these Terms limits liability where such limitation is not permitted by law (e.g., gross negligence, intentional misconduct, death or personal injury caused by our negligence).

  • Subject to the preceding sentence and the CPA, SA Shooter is not liable for any indirect, consequential, or special loss (including loss of profits, data, or business) arising from use of the Services or products.

  • Our aggregate liability for all claims related to the Services or a product purchase is limited to the amount you paid for the relevant product(s) or the transaction at issue, subject to your CPA remedies.

17. Indemnity

You agree to indemnify and hold SA Shooter harmless against claims, losses, and costs arising from your breach of these Terms, unlawful use of the Services, or violation of third-party rights.

18. Changes to the Services and Terms

  • We may modify or discontinue parts of the Services (including features or products) at any time.

  • We may update these Terms from time to time. The effective date appears at the top. Continued use after changes constitutes acceptance of the updated Terms.

19. Suspension & termination

We may suspend or terminate your access for suspected fraud, non-compliance with legal requirements (including FCA), breach of these Terms, security risk, or to comply with law. On termination, rights and obligations which by their nature should survive (e.g., IP rights, limitations of liability) will survive.

20. Governing law & disputes

  • These Terms are governed by the laws of the Republic of South Africa.

  • If a dispute arises, please contact us first so we can try resolve it informally. If unresolved, either party may refer the dispute to a South African court with jurisdiction. Nothing prevents you from using remedies under the CPA or an applicable ombud scheme.
